MAIN DUTIES AND RESPONSIBILITIES
  • Liaise with all relevant business and support areas within the company.
  • To monitor on a permanent basis and to assess, on a regular basis, the adequacy and effectiveness of the measures, policies and procedures put in place, and the actions taken to address any deficiencies in the firm’s compliance with its obligations.
  • Monitor and assess the level of compliance risk the company faces considering the investment and ancillary services provided, as well as the scope of financial instruments traded and distributed.
  • Monitor the adequacy and effectiveness of the measures and procedures of the company.
  • Advise and assist the relevant persons responsible for carrying out the investment services to follow the law.
  • Draft written reports to the Board of Directors on a quarterly basis on the implementations and effectiveness of the overall control environment for investment services and activities, on the risks that have been identified and, on the complaints, handling reporting as well as remedies undertaken or to be undertaken as well as include information about the financial instruments manufactured by the CIF, including information on the distribution strategy. These reports shall be presented to the management body and discussed during the meetings at least quarterly.
  • Complete, in collaboration with the other departments of the company all CySEC reports, and ensure they are submitted on time.
  • Work on related changes, to the company’s documentation.
  • Train and educate the staff of the company in respect with the compliance function according to the law including where necessary, provision of day-to-day assistance to the staff.
  • Communication the relevant status of the IOM to each employee and notify them of any relevant changes therein that relates to his/her role and responsibilities in the company.
  • Ensure that the executive directors or other hierarchically higher officers do not exercise inappropriate influence over the way in which a relevant person carries out the provision of investment service.
  • Develop, design, re-design the appropriate procedures of the company, so as to prevent and resolve potential conflicts of interest, ensuring that all the procedures regarding the company’s conflict of interest policy are in place.
  • Ensure that all employees can identify cases of potential conflicts of interest.
  • Decide whether to allow or not a transaction by notifying clients, after being informed by members of staff of a potential conflict of in the situation.
  • Disclose to clients or potential clients the general nature and any potentially present conflicts of interest.
  • Keep records regarding conflict-of-interest situations were relevant.
  • Consent and approve the company’s replacement policy.
  • Review the company’s website, on a monthly basis.
  • Monitor and review the dispatch to clients of the confirmations / notifications regarding the execution of their orders, as applicable.
  • Ensure the process of the termination of clients account is followed.
  • Ensure that all relevant information is included in the company’s outsourced agreements.
  • Receive and follow up client compliant in relation to the Backoffice department and filing these complaints.
  • Approve the information or standard FAQ which shall state the information that can be shared with clients before same are used by the company’s staff monitoring the operations of the complaints – handling process and consider complaints as a source of relevant information in the context of its general monitoring responsibilities.
  • Advise and assist the relevant persons responsible for carrying out investment services and activities to comply with the company’s obligations under law.
  • Monitor and develop the periodic review of product governance arrangements, to detect any risk of failure by the CIF. (If Any)
  • Compliance reports to the board of directors shall include information about the financial instruments manufactured by the CIF.
CANDIDATE PROFILE
  • Educated to  Bachelor’s Degree level or the equivalent in Law.
  • Solid experience within the Legal/ Compliance and AML department.
  • Previous experience within the forex industry is a must for this role.
  • Deep knowledge in financial laws and regulations.
  • Experience in dealing with regulators.
  • Must be a holder of both the Advanced CySEC and AML Examination.
  • Presentation skills.
  • Excellent reporting skills.
  • Must be able to work under high pressure.
  • Must be able to meet tight deadlines.
  • Highly approachable, trustworthy.
  • Ability to analyze and dissect information.
