A regulated Forex firm is looking for an MLRO to ensure the Company operates in accordance with all relevant regulatory obligations. Our client is based in Malta but will also have additional operations in Italy and Spain. The ideal candidate will have at least 5 years’ experience in CFD compliance, working in-house within a compliance department preferably at a sell-side investment firm. MAIN DUTIES AND RESPONSIBILITIES
  • Ensure, through regular monitoring that the Company complies with rules of the exchanges and clearing houses of which it is a member.
  • Establish appropriate policies, procedures and processes to ensure compliance by the Company and its staff with relevant regulatory and exchange obligations and to work with all business areas in a proactive manner to achieve this
  • Manage responses to audits and investigations from exchanges and the MFSA or FIAU
  • Oversee and ensure that effective regular monitoring reviews are carried out under the Compliance Monitoring Plan (and on an ad hoc basis where necessary)
  • Ensure, accurate and timely regulatory reports are submitted (EMIR, MiFID, REFIT etc.)
  • Prepare regular reports that accurately reflect the status of compliance of the Company and to advise management on relevant issues
  • Ensure appropriate regulatory training plans are in place for staff and the delivery thereof and that records are kept
  • Ensure support is given to internal projects which are required to meet regulatory and exchange requirements on a timely basis
  • Attend and participate in Management Committee meetings and bring to bear commercial, business and professional experience in the decision-making process
  • Oversee client onboarding process including KYC and due diligence checks
  • Ensure appropriate records and reports are maintained regarding the activities of the Compliance Department in accordance with all relevant regulatory requirements
  • Review, analyse, report on and make recommendations about new issues that may affect the business of the Company in regulatory areas and take appropriate action to ensure full compliance by the Company
  • Monitoring the effectiveness of the Company’s anti-money laundering systems and controls
  • Reporting to the Board on at least a quarterly basis (via an MLRO Report) and keeping the Senior Management updated on money laundering issues
  • Obtaining and using national and international findings, for example the findings of the FATF, IMF and World Bank to drive a robust culture
  • Ensuring that client and transaction monitoring is being undertaken
  • Assessing the risks of the Company’s client base and business activities in relation to money laundering on an on-going basis
  • Ensuring the Company’s policies and procedures are communicated effectively to all relevant employees
  • Perform the responsibilities of the Money Laundering Reporting Officer (MLRO)
  • Monitor new and proposed changes in the standards, legislation, and notifications from regulators and update internal policies and procedures accordingly
  • Identify and assess compliance risks, devise strategies for mitigating potentially adverse compliance and regulatory actions and share detailed risk reports
  • Liaise with regulatory authorities as required
  • Develop and lead the implementation of strategy for monitoring compliance, audits, reviews, and action plans.
CANDIDATE PROFILE
  • At least 5 years of experience in CFD compliance, working in-house within a compliance department preferably at a sell-side investment firm.
  • In depth knowledge and practical experience of compliance, knowledge of trading systems advantageous
  • Thorough knowledge of (or ability to learn) the relevant regulatory environments (which include but are not limited to MFSA, MiFID, EMIR, FIAU and any others that may be required from time to time
  • Business approach– ability to think outside the box, willing to be flexible in approach when required
  • Entrepreneurial mind-set - ability to manage own priorities and deliver in line with company requirements, ability to work alongside others teams with self-confidence
  • Maintain knowledge and awareness of the wide-scale regulatory issues that affect the Company and the industry
  • Maintain effective oral and written communication including detailed reports and other material of a technical and/or complex nature where appropriate
  • Develop knowledge regarding the position of the Company in the industry and in the overall political, economic and regulatory environment
  • Maintain comprehensive regulatory knowledge of products and services in own areas of responsibility
  • The ability to follow market developments and know what the competition is doing
  • The ability and motivation to expand and share one’s own technical and professional expertise and knowledge
  • The experience with rules and regulations applicable to broker-dealers
  • The substantial experience when responding to regulatory inquiries
  • The strong attention to detail
  • The ability to initiate and drive projects to completion with minimal guidance and with a sense of urgency
  • A strong organization, prioritization and time management skills.
